Team BeachSweat Instructor Contest Terms and Conditions
Background. Team BeachSweat Instructor/Producer Contest (the “Contest”) requires each entrant (each, an “Entrant”) to create one (1) video showing why they should become the next BeachSweat instructor/producer (each submission, an “Entry”).
How to Enter. Any person meeting the eligibility requirements in Section 3 of these Terms and Conditions may complete an Entry by uploading a video no longer than one hundred twenty (120) seconds through the designated BeachSweat entry page.
Eligibility. No Purchase Necessary. The Contest is open only to legal residents of the fifty (50) United States, and the District of Columbia, who are at least 21 years of age at the time of entry. Current employees and contractors of Sponsor and their immediate family members and household members are not eligible to participate in any part of the Contest including voting on Entries. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.
Rules. The Contest period will run from [beginning date] at 12:00 AM to [end date] at 11:59 PM (the “Contest Period”). All Entries will be initially reviewed by the Sponsor and the Sponsor will, once per week for four (4) weeks during the Contest Period, choose twenty (20) Entries per week to display on the BeachSweat voting page. The Sponsor may, in its sole and absolute discretion, determine which Entries to post on the BeachSweat voting page. The Entry with the most votes during each such one-week period will be declared the weekly winner and the respective Entrant will receive a cash prize of two hundred fifty dollars ($250.00) USD and an hour with our Fitness Director to prepare their final submission (Value: $250 USD). After the conclusion of the fourth (4th) weekly voting period, the four (4) winning Entrants will be declared finalists and their initial Entries or a new Entry, submitted at their discretion, will be placed on a final voting webpage for a period of [X] days (the “Final Voting Period”). The Entry with the most votes during the Final Voting Period will be declared the grand prize winner and the respective Entrant will receive a cash prize of two thousand dollars ($2,000) OR an at home filming kit including 2 cameras, 2 tripods, lighting and a gimbal for motion video (approximate retail value (“ARV”): $2500). The winner may also be considered for the opportunity, but not the guarantee, to be a BeachSweat Content Producer or Instructor. The Sponsor will, in its reasonable discretion, determine (a) if the Entrant is qualified to become a BeachSweat producer or instructor (whether as an employee or contractor) and (b) the terms and compensation of the position, if and when offered to the Entrant. The Sponsor shall determine the validity of all voting in its sole discretion. Participation in the Contest constitutes each Entrant’s acceptance of the Terms and Conditions. Winner shall be liable for paying tax on any winnings. All prize details not specified in these Terms and Conditions will be determined in Sponsor’s sole and absolute discretion. Any difference between stated ARV and actual value of prize will not be awarded. Winner will not receive a difference between actual and approximate retail value. Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize(s) they receive. The ARV of the prize(s) is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner may be required to provide Sponsor with a valid social security number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winner for the actual value of the prize(s) received.
Additional Entry Guidelines. Each Entry shall be no longer than one hundred twenty (120) seconds and must be uploaded through the webpage provided by the Sponsor. No Entry shall include any of the following:
nudity or profanity;
copyrights, trademarks, or other intellectual property not owned by the Entrant;
any person other than the Entrant;
anything illegal, defamatory, or hateful;
any derogatory characterization of any person or group of people; or
anything else which the Sponsor, in its sole discretion, determines to be inappropriate.
Sponsor. The Contest shall be administrated and sponsored by Beach Sweat Inc., [1142 Old Okeechobee Rd #8, West Palm Beach, FL 33401] (“Sponsor”). You may obtain a list of the winners by sending a request, along with a stamped, self-addressed envelope, to this address.
Publicity and Likeness. The Entrant acknowledges and agrees that the Entry will be shared online and through any other medium as determined solely by the Sponsor. Sponsor reserves the right to promote each Entry however it sees fit. The Entrant hereby permits the Sponsor and its affiliates to use the Entry and the Entrant’s name and likeness in order to promote the Sponsor, the Sponsor’s services, the Contest, the Entrant, or the Entry, both during and after the Contest. The Sponsor shall not be required to pay any compensation or make any attribution. The Entrant specifically waives any right of publicity or similar right. All entries will become the exclusive property of the Sponsor and will not be returned. Proof of submission will not be deemed proof of receipt by Sponsor.
Notification. All winners will be notified via email shortly after winning any portion of the Contest. Winners must claim their prize within three (3) business days or the Sponsor may, in its sole discretion, award the prize to the second-place winner.
Release. Each Entrant expressly acknowledges and agrees that the Sponsor will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including (but not limited to) damages resulting from personal injury, death, or dismemberment, damages for loss of use, data, or other intangible losses, costs, fees, monetary losses, or losses of other benefits, even if the Sponsor has been advised of the possibility of such damages. In no event will the Company be liable to the Entrant for any amount of money over Two Hundred U.S. Dollars ($200.00), which you acknowledge to be a fair and reasonable sum in the event of any loss by you of any kind.
Additional Terms. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any Entrant if the Sponsor believes that the Entrant has violated any of the rules of this Contest or has manipulated, or attempted to manipulate, the voting. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. No failure or delay of the Sponsor in exercising any right hereunder shall be deemed a waiver of such right.
Governing Law and Disputes. This Agreement shall be governed and construed in accordance with the laws of the State of Florida. Any dispute arising hereunder, or related to the terms hereof, shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida.
Posting of Winners. Sponsor will post the winners’ names on the BeachSweat website within five (5) business days of the end of each portion of the Contest.
